“Diamond In The Rough” Contest (the “Contest”)
The Contest runs from May 31, 2024, at 9:00 a.m. to September 15, 2024, at 9:00 p.m. (MDT) (the “Contest Period”)
Draw Date: A random draw will be held on September 16, 2024, to select the Contest winner.
Ways to Enter
Regular Entry: Fill in a ballot form in-person, available from a Snow Valley Guest Services team member, located in the Rainbow Valley Campground Building at 13206 Rainbow Valley Road NW, Edmonton, AB, then place the ballot form into the entry box.
Limit of one (1) regular entry per person, per day. Any attempt to manipulate the Contest will result in the Contestant being disqualified.
Bonus Entry: Make a qualifying purchase, as outlined below, to receive the described amount of bonus entries. Group discounted purchases, birthday packages, and bulk-voucher redemptions are not eligible for Bonus Entries. There is no maximum to the number of bonus entries that a person may receive in one day.
Pay Dirt mining rough – 1 bonus entry
Fossil Find mining rough – 1 bonus entry
Emerald Strike mining rough – 1 bonus entry
All Access Pass – Pay Dirt – 1 bonus entry
All Access Pass – Fossil Find – 1 bonus entry
Mother Lode mining rough – 2 bonus entries
Mega Strike mining rough – 4 bonus entries
Odds of Winning: Odds of winning will depend on the total number of entries received.
Eligibility
The Contest is open to all residents of Canada (excluding residents of Quebec) who have reached the age of majority in their province of residence on or before the Draw Date; except for employees and their immediate families, or board members and their immediate families, of either Snow Valley Ski Club and/or Independent Jewellers.
You agree to abide by the Rules and Regulations set forth herein, subject to all applicable federal, provincial and municipal laws. Winner must authorize Snow Valley Ski Club and Independent Jewellers to advertise and publish the Winner’s name and photograph, without compensation or other consideration, in any forthcoming publicity. Acceptance of this permission is a condition of eligibility.
Selected entrant will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, a time-limited, mathematical skill-testing question.
Prize
The Winner of the Contest will win a 14kt Yellow and White Gold, 1.00ct Canadian Diamond Ring. Appraised Value of $8,100. Prize is provided by Independent Jewellers. The prize is non-transferable, and no prize substitutions or cash redemptions are allowed except as provided herein. Where applicable, all taxes and fees, including but not limited to any shipping fees, administration fees, warranty fees, on prizes are the responsibility of the winners.
Note: Snow Valley Ski Club and/or Independent Jewellers will NOT reimburse any warranty, administration fees for deferring payment, or delivery charges.
The Eligible Winner, if unable to pick up the prize in-person from Independent Jewellers at 11248 170 St NW, Edmonton, AB T5S 2X1, will be solely and completely responsible for shipping the prize, including any and all fees, warranties, and other costs associated.
Draw Procedure
On September 16, 2024, an Independent Jewellers representative will conduct one (1) random draw from all Entries to obtain the Eligible Winner.
An Independent Jewellers representative will make all reasonable efforts to contact eligible Winners by email after the draw date. If any Eligible Winner does not reply to the phone call, email, or contact Independent Jewellers within three (3) days of Independent Jewellers’ first contact attempt to that effect (“Contact Date”), that person will be disqualified from winning and Independent Jewellers will draw a new Eligible Winner.
If the email address and/or address on the form are illegible, to the best of Snow Valley Ski Club and Independent Jewellers abilities to interpret or read it, the entry will be disqualified and a new entry will be drawn.
Prize Winner Declaration
The Eligible Winner whose name was selected on the Draw Date must:
—i) Be resident of Canada (excluding Quebec) and who is over the age of majority in their province of residence;
—ii) Within three (3) business days of the Contact Date, correctly answer a time-limited mathematical skill-testing question without the assistance of any person or mechanical or recording device. The skill-testing question will be asked at a predetermined time and place;
—iii) Sign a declaration and release form confirming compliance with the Contest Rules and acceptance of the prize; and
—iv) If the Eligible Winner cannot correctly answer the Skill-Testing Question, that Eligible Winner will be disqualified. Should this occur, a new Eligible Winner will be drawn and contacted, as outlined in the Draw Procedure.
By accepting the prize, the winner agrees to Snow Valley Ski Club and Independent Jewellers’ use of his/her name, city, province or territory of residence and/or photograph for publicity purposes without compensation.
Additional Terms
By entering the Contest:
You agree that these Contest Rules and Snow Valley Ski Club and Independent Jewellers’ records of the draw or any other aspect of this contest shall be final and conclusive in all respects.
You release, discharge, indemnify and hold harmless Snow Valley Ski Club, Independent Jewellers, and its trustees, directors, officers, and employees from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.
You agree that Snow Valley Ski Club and Independent Jewellers reserve the right, at their discretion, to disqualify any individual who tampers with, or who attempts to tamper with, the entry process.
Limitation of Liability
Snow Valley Ski Club and Independent Jewellers are not responsible for any printing or typographical errors in the materials related to the Contest and/or for any transactions entered late, incorrectly or lost due to computer or electronic malfunctions or mail that cannot be delivered for any reason. Snow Valley Ski Club and Independent Jewellers reserve the right to amend or vary the Official Contest Rules, including the imposition or addition of new rules which are deemed by Snow Valley Ski Club and Independent Jewellers, in their best discretion, necessary for business efficacy.
Privacy Policy
If none of the check boxes consenting to receive communications from either Snow Valley Ski Club or Independent Jewellers are selected on the Entry form, Snow Valley Ski Club and Independent Jewellers will still, and only, use the email address and phone number on the form to contact the Eligible Winner if their Entry is chosen.
If the entrant, on their entry form, has checked one or more of the optional boxes asking to be added to the email list of the named party (either Snow Valley Ski Club and/or Independent Jewellers), they will be added by that party to their email marketing channels. All email marketing subscribers may unsubscribe at any time using the links in the emails.
Other
Law. The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the province of Alberta, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest rules, rights and obligations between entrants and Snow Valley Ski Club and Independent Jewellers, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Edmonton, Alberta.
Rule Amendments. Snow Valley Ski Club and Independent Jewellers reserve the right, in their discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of Snow Valley Ski Club and Independent Jewellers corrupts, or threatens to corrupt, the security or proper administration of the Contest.
Intellectual Property. All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by Snow Valley Ski Club and/or Independent Jewellers. All rights reserved. Unauthorized copying or use of any of the Snow Valley Ski Club or Independent Jewellers’ intellectual property without their express written consent is strictly prohibited.
